SERVICE CONTRACT
A service contract is established with TIKAL EXPEDITION once the booking has been confirmed and the full payment or the required advance for the contracted service has been received.
Confirmation may be made by email, voucher, booking confirmation or other electronic means used by TIKAL EXPEDITION.

Prices include only the services specified in the description, itinerary, inclusions section and/or quote corresponding to the contracted product.
Any service not expressly listed will be considered additional.
Prices shown are subject to change for future bookings without prior notice. Price changes will not affect a previously confirmed and paid booking.
When the customer requests modifications or additional services after having confirmed their reservation, additional charges may be generated depending on the nature of the change requested.
Airfares are dynamic and subject to availability, fare conditions, and modifications established by the airlines.
The price of the service does not include, unless expressly stated: visas, immigration fees, taxes or entry and exit fees, unspecified meals, alcoholic beverages, personal expenses, optional hotel services, tips or other services not expressly included in the booking.
SERVICE MODALITY
The services offered by TIKAL EXPEDITION They can be provided under different modalities, according to the characteristics expressly indicated on the product page, itinerary, quote or corresponding booking confirmation.
GROUP TOUR
A collective or group tour is one in which the passenger shares the service with other travelers and is subject to a pre-established itinerary, dates, times, routes and transfers.
Hiring a group tour It does not represent the exclusive hiring of a vehicle, driver or guide by a passenger.
The number of passengers who ultimately participate in the service does not modify the contracted modality.
For logistical reasons, TIKAL EXPEDITION may distribute passengers between one or more vehicles without this turning the collective service into a private one, as long as the essential nature of the contracted service is maintained.
The included transfers correspond to the dates, times, routes and destinations contemplated in the contracted itinerary.
PRIVATE TOUR
A tour is considered private only if it has been expressly quoted, booked and confirmed under that modality.
Private service grants exclusivity to the corresponding passenger or group. within the itinerary, dates, times, route and contracted services.
The private option does not mean unlimited availability of the vehicle, driver or guide outside of the conditions established in the booking.
Any extension, route change, additional transfer, date modification, or other service different from the one contracted may generate an additional cost.
TRANSPORTATION SERVICE
A transport service is considered to be one specifically contracted for the transfer of passengers between one or more previously established points, without necessarily constituting a tour, excursion or tourist package.
The transport service may be provided under the following modality: private or shared, as expressly stated in the product, quote or booking confirmation.
In the services of private transport, The exclusivity of the vehicle applies only to the date, time, route, origin, destination, and other agreed-upon conditions. This does not imply unlimited availability of the vehicle or driver.
In the services of shared transportation, The passenger will be subject to the schedules, routes, pick-up points and destinations established for the corresponding service.
TIKAL EXPEDITION will assign the appropriate vehicle according to the number of passengers, route, destination, availability and operational needs, unless a specific type of vehicle has been expressly contracted.
Pick-up and drop-off times may vary due to traffic, road conditions, border controls, weather, closures, accidents, or other operational circumstances.
Any modification of date, time, route, origin, destination, number of passengers, waiting time or other originally contracted condition will be subject to availability and may generate additional charges.
Transportation services may be subject to Specific policies regarding changes, cancellations, waiting times, and no-shows, indicated in the product, quote or corresponding confirmation.
AIR SERVICES
Air services are considered to be those that include or comprise commercial airline tickets, charter flights, helicopter flights, or other air transport services managed or marketed as part of a TIKAL EXPEDITION service.
Air services are subject to availability and the operational, commercial, change, cancellation and refund conditions established by the corresponding airline or air operator.
Airline ticket prices may be dynamic and vary until the time of issuance. Once the ticket is issued, the corresponding fare conditions will apply.
Schedules, routes, aircraft and operations may be modified, delayed or canceled by the air operator due to weather conditions, technical, airport, regulatory, operational or safety reasons.

SERVICE CHANGES AND MODIFICATIONS
Changes requested before the start of the service will be subject to the specific conditions for changes and cancellations indicated in the reserved product.
Any modification requested by the passenger once the service has started, including changes to itinerary, schedule, route, pick-up point, drop-off point, accommodation, activities or early return, will be subject to availability and may incur additional charges.
In group services, any individual request that requires altering the established schedule for the group may require the hiring of private transport or other additional services.
In private services, any modification that exceeds the itinerary, schedule, duration, route or services originally contracted may also generate additional charges.
Having paid the full amount for the tour, transport or package This does not imply that the passenger can substitute the contracted services for different ones or unilaterally modify the booking conditions without incurring the corresponding costs..
TIKAL EXPEDITION will inform, where possible, the cost of the modification or additional service before its provision so that the passenger can accept or reject it.
VOLUNTARY RETIREMENT AND UNUSED SERVICES
The passenger may voluntarily decide to abandon, reduce or end a tour or service early.
The decision to terminate the service early does not obligate TIKAL EXPEDITION to modify the originally contracted schedule.
Services that have been contracted and are available, but which the passenger voluntarily decides not to use, They do not automatically generate the right to a refund, compensation, or credit to acquire other services., subject to applicable policy and relevant legislation.

CHANGE AND CANCELLATION POLICY

RESERVATIONS ON SPECIAL DATES

MODIFICATIONS DURING SERVICE

The voluntary non-use of certain services does not in itself constitute a cancellation attributable to TIKAL EXPEDITION nor does it automatically generate a right to a refund.
Cancellations must be made through the official channels indicated by TIKAL EXPEDITION.
NO-SHOW
It will be considered No-Show when the passenger does not appear at the place and time established to start the service or when he arrives after the scheduled departure and it is not reasonably possible to incorporate him into the tour.
No-shows will be subject to the specific cancellation policy corresponding to the reserved service.

HOTEL SERVICES
When a tour or package includes accommodation, TIKAL EXPEDITION will contract the establishments indicated in the booking or establishments of reasonably equivalent characteristics when there is a circumstance that prevents the use of the accommodation originally planned.
Check-in and check-out times will be set by each accommodation.
Personal expenses, additional services and other costs not included in the reservation will be the responsibility of the passenger.
Once accommodation has been booked and is available, the passenger's voluntary decision not to use a night It does not automatically imply a refund or conversion of its value into credit for another service.
Voluntary hotel changes requested by the customer will be subject to availability and may result in rate differences, penalties, or other additional costs.

LOCAL, COMMUNITY AND THIRD-PARTY SUPPLIERS
Some tours may include services operated by local and community providers.
TIKAL EXPEDITION coordinates these services as part of the contracted itinerary.
Certain components of the trip may also be provided by hotels, carriers, restaurants, airlines, community operators, park managers, archaeological sites, or other specialized providers.
The terms and conditions of these providers may apply to the services they directly provide, without prejudice to the legal obligations of TIKAL EXPEDITION.
RESPONSIBILITY AND OBLIGATIONS
TIKAL EXPEDITION undertakes to provide the contracted services in accordance with the conditions, modalities, itineraries and inclusions established in the reservation.
The passenger acknowledges that certain tourist services take place in archaeological sites, jungle areas, trails, roads, bodies of water, remote areas and other natural environments that may involve inherent risks of the activities carried out.
TIKAL EXPEDITION will not be liable for injuries, losses, delays, additional expenses or damages arising from acts or omissions attributable to the passenger, failure to comply with safety instructions, reckless conduct, voluntary abandonment of the itinerary or circumstances beyond the reasonable control of the company, without prejudice to the legally corresponding liabilities.
The passenger must follow reasonable instructions provided by guides, drivers, authorities, park managers and other personnel responsible for the operation.
When a passenger ignores safety instructions or restrictions and such conduct causes damage, injury, loss of services or additional expenses, these will be the responsibility of the passenger to the extent that they are a consequence of his actions.
Each passenger is responsible for evaluating the characteristics and requirements of the contracted activities and promptly communicating any relevant circumstances that the operator should reasonably be aware of in order to provide the service safely.
TIKAL EXPEDITION may recommend that a passenger not participate in or suspend a certain activity when there are objective reasons related to their safety or the safety of the group.
TIKAL EXPEDITION will not be responsible for loss or forgetting of money, documents, telephones, cameras, luggage or other personal items when the fact is not attributable to the company or its staff.
Acceptance of these Terms and Conditions does not represent a waiver by the passenger of any legally applicable rights nor an exoneration of TIKAL EXPEDITION from liabilities that cannot be legally excluded.
ILLNESS, INJURY OR EMERGENCY DURING SERVICE
If during the service a passenger experiences illness, injury, indisposition or any situation that prevents them from continuing normally with the itinerary, they must inform the guide, driver or representative of TIKAL EXPEDITION as soon as possible.
TIKAL EXPEDITION will endeavor to provide reasonable assistance and facilitate, where possible, access to medical services, transportation, or other necessary assistance.
Expenses arising from medical care, medicines, hospitalization, evacuation, extraordinary transport or other services not originally included will be the responsibility of the passenger, except when such expenses arise from an event for which TIKAL EXPEDITION is legally responsible.
An illness, injury, or personal situation may justify a passenger's decision to withdraw from the tour; however, It does not automatically modify the originally contracted services nor does it convert unused services into credit for other services..
If the passenger needs to modify their transfer or hire additional transport due to this situation, TIKAL EXPEDITION will try to assist in its coordination, subject to availability and the corresponding costs.
In situations that may reasonably represent a medical emergency, TIKAL EXPEDITION may prioritize the safety and assistance of the passenger over the continuation of the corresponding tourist activity.
FORCE MAJEURE AND EXTRAORDINARY CIRCUMSTANCES
TIKAL EXPEDITION will not be responsible for delays, modifications or inability to provide certain services when they are a consequence of circumstances beyond its reasonable control.
These circumstances may include natural phenomena, adverse weather conditions, fires, road closures, closures of tourist sites, government regulations, restrictions imposed by authorities, social conflicts, strikes, demonstrations, border issues, health emergencies, or other extraordinary events.
When one of these circumstances occurs, TIKAL EXPEDITION will make reasonable efforts to reorganize the service, modify the order of the itinerary, or provide alternatives when operationally possible.
Extraordinary circumstances will not automatically imply the right to use services different from those originally contracted. Any solution must be evaluated according to the nature of the event, the services affected, the providers' terms and conditions, and applicable law.
PUNCTUALITY AND ADHERENCE TO THE ITINERARY
The passenger is responsible for showing up at the designated pick-up or meeting places at the indicated times.
In group services, the operation must reasonably respect the group's schedule and cannot be delayed indefinitely due to the absence or delay of a passenger.
If a passenger misses an activity, transfer, or other service due to being late, TIKAL EXPEDITION will endeavor to assist when possible; any additional transportation or service needed to rejoin the itinerary may incur an additional cost.
LUGGAGE AND PERSONAL ITEMS
Each passenger is responsible for the care and safekeeping of their luggage, documents, money, electronic devices, and other personal belongings.
It is recommended not to leave valuables unattended in vehicles, hotels, restaurants, rest areas, or other places visited during the tour.
In case of loss or damage, liability will be determined according to the circumstances of the event and the applicable legislation.
TRAVEL DOCUMENTATION AND REQUIREMENTS
Each passenger is responsible for having the necessary personal and immigration documentation to carry out the contracted trip.
For international services, it is the passenger's responsibility to verify the requirements for passports, visas, immigration permits, authorizations for minors, vaccinations or other documents required by the relevant authorities.
TIKAL EXPEDITION can provide general information, but immigration requirements may vary depending on nationality and individual circumstances.
Expenses or loss of services caused by incomplete documentation or by the inadmissibility of the passenger by an authority will be the responsibility of the client when the cause is attributable to him.
PASSENGER CONDUCT
The passenger must maintain a respectful conduct towards other travelers, guides, drivers, suppliers, local communities and other people related to the provision of the service.
Conduct that puts the safety of the passenger, the group, the staff or third parties at risk, or that seriously interferes with the normal development of the service, will not be permitted.
TIKAL EXPEDITION may take reasonable measures when a passenger's conduct poses an objective risk to safety or makes it impossible to continue the service normally.
APPLICABLE LAW AND VALIDITY OF THE CONDITIONS
These Terms and Conditions shall be governed by and construed in accordance with the applicable laws of the Republic of Guatemala.
Nothing in these Terms and Conditions shall be intended to limit or exclude those consumer rights that, under applicable law, are inalienable.
If any provision of these Terms and Conditions is declared invalid, illegal or unenforceable by a competent authority, such circumstance will not affect the validity and enforceability of the other provisions, which will remain in force to the extent legally applicable.
